A. Account Creation: To access certain features of the Services, users must create an account. The required information includes the child’s name, parent’s or caregiver’s name or username, email, password, and responses to the child profile/onboarding questionnaire.

B. Data Usage and Privacy: The use of personal data collected during account registration and throughout your use of the Services is subject to our Privacy Policy. Any updates to the use of personal data or changes to third-party service providers involved in handling such data will be communicated through updates to the Privacy Policy.

C. Third-Party Services: We use various third-party services such as Klaviyo for email marketing, PostMark for transactional emails, Google Analytics, and PostHog for tracking. The usage of these services is covered under our Privacy Policy, and users are encouraged to review it periodically.

D. User Responsibilities: Users are responsible for maintaining the confidentiality of their account credentials and are liable for any activities that occur under their account. The Company reserves the right to disable accounts that are found to be in violation of these Terms.

B. Permissions: Users are granted a limited, non-exclusive license to use user-generated content for personal use only. Commercial use or distribution of any content from the Services is strictly prohibited.

C. Company Rights: By using the Services, users grant the Company an exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display user-generated content for the duration of the Service agreement. This license is necessary for the provision and enhancement of our Services.

D. Third-Party Content: The Services may include content generated by third-party LLMs and Generative AI tools. Users acknowledge that such content may be subject to inaccuracies, and the Company is not liable for any errors or inconsistencies arising from AI-generated content.

5. Payment and Transactions
A. Subscription Services: The Services operate on a subscription basis with options for 3-month, 6-month, or 12-month plans. All payments are processed through Stripe and are subject to their terms and conditions.

B. Cancellation Policy: Users may cancel their subscription at any time through their account settings. Upon cancellation, users will retain access to the Services until the end of the current subscription period. No refunds will be provided, as all sales are final.

C. Recurring Payments: Subscription plans are based on recurring payments, which will continue until canceled by the user. Users are responsible for managing their subscription and ensuring that payment details are up to date.

6. Liability and Disclaimers
A. Use of AI Solutions: The Company leverages third-party AI solutions to generate text, images, audio, and video content. While we strive to ensure high-quality outputs, the nature of AI technology means that content may occasionally include inaccuracies or “hallucinations.” The Company disclaims any liability for the quality or accuracy of AI-generated content.

B. Limitation of Liability: To the fullest extent permitted by law, the Company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services. This includes any emotional, mental, or physiological impacts the content may have on children or parents.

C. Indemnification: Users agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses arising from the use of the Services or violation of these Terms.

7. Termination and Suspension
A. Termination Conditions: The Company reserves the right to terminate or suspend a user’s account at its sole discretion, particularly in cases of excessive content generation, frequent changes to the child’s profile, or any activities that suggest the content is being used for commercial purposes rather than personal use.

B. Moderator Responsibilities: As account holders, parents or caregivers are responsible for moderating the content consumed by their children. The Company does not actively monitor user-generated content.

C. Effect of Termination: Upon termination of an account, the user’s access to the Services will be revoked, and any remaining subscription period will be forfeited.

8. Dispute Resolution
A. Dispute Handling: The Company will handle disputes on a case-by-case basis. Users are encouraged to contact the Company directly via email at [email protected] to address any issues or concerns.

B. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Lithuania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Lithuania.

C. Communication: All communications related to dispute resolution will be conducted via email. Users agree to receive communications electronically and acknowledge that such communications satisfy any legal requirement that such communications be in writing.
